5. When You Provide Personal Data About Other People
If you submit Personal Data about anyone other than yourself (for example, a Property owner, co-buyer, tenant, family member, employee, broker, or referee), you represent and warrant that:
(a) you have a lawful basis to share that data with us (including, where required, the data subject's informed consent);
(b) you have informed the data subject of this Policy and the way their data will be processed by MENA Homes;
(c) the data is accurate, current, and complete; and
(d) you have authority to act on the data subject's behalf in respect of their PDPL rights.
You will defend, indemnify, and hold the MENA Homes Group harmless from and against any claim, fine, penalty, or expense arising from any breach of these warranties.
6. How We Share Your Personal Data
We share Personal Data only in the circumstances described below. We do not sell your Personal Data, except that we may license, sell, and otherwise commercialise Anonymised Data as described in Section 4 and Section 8.
6.1 With Agents
When you submit an enquiry about a Listing, we share your contact details and the content of your enquiry with the Agent who published the Listing (and, where applicable, with the brokerage and any individual broker assigned to the enquiry). The Agent becomes an independent data controller of that data and processes it under their own privacy policy. MENA Homes is not responsible for any Agent's processing of your data after disclosure.
When an Agent publishes a Listing, the Agent's professional contact details (name, brokerage, photograph, telephone, email, BRN, Trakheesi number) are made publicly available on the Listing as required by the regulated advertising disclosure regime.
6.2 With Service Providers (Processors)
We use third-party service providers to operate the Platform. These providers process Personal Data only on our instructions, under written agreements that meet PDPL requirements. Categories include:

We may share Personal Data within the MENA Homes Group for operational, administrative, security, marketing, analytics, research, and product-development purposes. We may also share Personal Data with our parent companies, subsidiaries, affiliates, branches, joint-venture partners, prospective and actual purchasers, investors, lenders, and successors, in connection with corporate restructuring, financing, sale of business or assets, merger, acquisition, due diligence, or insolvency, in each case subject to confidentiality and PDPL requirements.
6.4 With Marketing and Commercial Partners (with Consent)
Where you have consented, we may share Personal Data with carefully selected marketing and commercial partners (such as mortgage providers, conveyancers, valuers, moving services, insurance, and home-services partners) so that they can contact you with offers and information you have requested.
6.5 With Regulators, Courts, and Authorities
We may disclose Personal Data to regulators, courts, law-enforcement agencies, tax authorities, sanctions authorities, and other competent authorities where:
- we are required by Applicable Law, court order, or binding regulatory request; - the disclosure is necessary to comply with our legal obligations (including AML/CFT, tax, sanctions, real-estate regulation, or cybercrime reporting); or - we reasonably believe that disclosure is necessary to protect the rights, property, or safety of MENA Homes, our Users, or the public.
6.6 In Public Areas of the Platform
If you publish a Listing, post a review or comment, or otherwise contribute Content to public areas of the Platform, that information will be visible to other Users and to the public, and may be indexed by search engines. Do not include Personal Data in public areas unless you intend it to be public. Once made public, Personal Data may be cached, copied, archived, and shared by third parties beyond our control.
6.7 With Anonymised-Data Licensees
We may license, sell, distribute, or otherwise share Anonymised Data with any third party for any purpose. Once Personal Data has been Anonymised, it is no longer Personal Data, no longer subject to the PDPL or this Policy, and you have no rights over it.
7. International Data Transfers
We are based in the UAE and primarily process Personal Data within the UAE. However, our service providers, group companies, and partners may process Personal Data in other jurisdictions, which may include (without limitation) the European Union, the United Kingdom, the United States, India, the Philippines, Singapore, and other countries.
Under Articles 22 and 23 of the PDPL, transfers of Personal Data outside the UAE are permitted where:
(a) the destination country has been assessed as providing an adequate level of protection by the UAE Data Office;
(b) the transfer is governed by appropriate contractual safeguards (including standard contractual clauses, binding corporate rules, or equivalent measures);
(c) you have given your explicit consent to the transfer after being informed of the risks;
(d) the transfer is necessary for the performance of a contract with you, the conclusion or performance of a contract concluded in your interest, legal claims, public interest, vital interests, or other grounds permitted by the PDPL.
By using the Platform, you acknowledge that we transfer Personal Data internationally on these bases, including to jurisdictions that may not have data-protection laws considered equivalent to those of the UAE.
You may request more information about the safeguards applicable to a specific transfer by contacting privacy@menahomes.com.
8. How Long We Keep Your Personal Data and Our Use of Anonymised Data
8.1 Retention of Personal Data
We retain Personal Data for as long as we reasonably consider necessary to fulfil the purposes for which it was collected, to comply with legal, accounting, regulatory, audit, dispute-resolution, and reporting requirements, to establish, exercise, or defend legal claims, and to protect the integrity and security of the Platform.
The actual retention period depends on the type of data, the purpose, the risk profile, and applicable legal requirements. As a general guide:
- Account data: for the duration of your account, plus a reasonable archival period after closure (typically several years) for audit, dispute-resolution, fraud-prevention, and regulatory purposes. - Listings (Agents): while the Listing is active, plus an archival period thereafter. - Enquiry, communication, and call-recording data: typically for several years following the interaction, to support service quality, dispute resolution, regulatory cooperation, and the defence of claims. - Financial, tax, and accounting records: as required by UAE tax, VAT, and accounting law (currently a minimum of five (5) years). - AML/CFT records: as required by UAE AML/CFT law (currently a minimum of five (5) years). - Marketing preferences: until you withdraw consent or opt out, plus a record of the withdrawal itself for compliance purposes. - Cookies and analytics data: in accordance with the Cookie lifetimes set out in our Cookie settings. - Backups: for the operational backup-retention cycle, after which data is purged. Personal Data in backups remains subject to the operational restoration controls and is not actively processed.
We may retain Personal Data beyond the periods above where reasonably necessary for any purpose described in Section 4, where required or permitted by Applicable Law, or where consented to by you.
8.2 Anonymisation and Use of Anonymised Data
When Personal Data is no longer required for the purposes for which it was collected, we may either delete it or Anonymise it. Once Anonymised, the data is no longer Personal Data and is no longer subject to the PDPL or this Policy.
We may retain, use, disclose, license, sell, distribute, and otherwise commercialise Anonymised Data for any purpose, indefinitely, including (without limitation) the creation of market reports, indices, benchmarks, statistical analyses, and machine-learning models. You have no rights over Anonymised Data.
9. Cookies and Similar Technologies
We use cookies, pixels, software development kits (SDKs), local storage, fingerprinting, and similar technologies (together, "Cookies") to operate the Platform, remember your preferences, measure performance, prevent fraud, and (with your consent where required) personalise content and advertising and build audience segments.
Categories of Cookies we use:
- Strictly necessary Cookies — required to operate the Platform and provide features you have requested (authentication, session management, security, fraud prevention, load balancing). These do not require your consent and cannot be switched off. - Functional Cookies — remember your preferences and improve usability (language, search filters, recently-viewed Listings). - Analytics Cookies — help us understand how the Platform is used. - Advertising and marketing Cookies — used to deliver relevant advertising on the Platform and on third-party platforms, measure campaign effectiveness, build audience segments, and create lookalike audiences.
You can manage your Cookie preferences through the cookie banner displayed when you first visit the Platform and through the Cookie settings link in the footer. You can also block or delete Cookies through your browser settings, although doing so may significantly impair the functionality of the Platform, and we are not responsible for any loss of functionality resulting from your Cookie choices.
10. Marketing Communications
We send marketing communications (newsletters, promotions, market reports, curated Listings, partner offers, retargeting messages) only where you have consented or as otherwise permitted by Applicable Law.
By providing your contact details and indicating your marketing preferences, you consent to receive marketing communications from us across one or more channels (email, SMS, WhatsApp, push notification, voice, postal mail, and in-app messages), at a frequency we reasonably determine, including communications about MENA Homes services, new features, market intelligence, partner offers, and curated Listings.
You can withdraw your consent at any time by:
- clicking "unsubscribe" in any marketing email; - replying "STOP" or following opt-out instructions in any SMS or WhatsApp; - changing your notification preferences in your account settings; or - contacting privacy@menahomes.com.
Withdrawal of consent does not affect:
- the lawfulness of processing carried out before withdrawal
- processing under another lawful basis; or (c) transactional and service communications, which we will continue to send while you have an active account or pending enquiry.
11. Your Rights Under the PDPL
You have the following rights under the PDPL in respect of your Personal Data. Each right is subject to the conditions, exceptions, and limitations set out in the PDPL and its Executive Regulations, including those described in this Policy.
11.1 Right to Information (Art. 13)
You have the right to be informed about how we collect and use your Personal Data. This Policy is the primary way we provide this information.
11.2 Right of Access (Art. 14)
You may request a copy of the Personal Data we hold about you and information about how we process it. We may decline an access request, in whole or in part, where the request:
- is unclear or insufficiently specific; - would adversely affect the rights, freedoms, or privacy of another person; - relates to data subject to legal privilege or confidentiality; - is manifestly unfounded, repetitive, or excessive; or - would, in our reasonable judgment, be exempt from disclosure under the PDPL or any other Applicable Law.
11.3 Right to Rectification (Art. 15)
You may request that we correct inaccurate or incomplete Personal Data. You are responsible for keeping the Personal Data in your account accurate, complete, and current, and we are not liable for any consequence of inaccurate, incomplete, or out-of-date data you fail to update.
11.4 Right to Erasure (Art. 15)
You may request that we delete your Personal Data. We may decline an erasure request, in whole or in part, where retention is reasonably necessary:
- to provide the Platform or any service you have requested; - to comply with Applicable Law, court order, regulatory requirement, or any legal obligation (including tax, VAT, accounting, AML/CFT, sanctions, and real-estate regulation); - to establish, exercise, or defend legal claims; - to protect the rights, property, or safety of MENA Homes, our Users, or the public; - to detect, prevent, or investigate fraud, security incidents, or breaches of the Terms; - for archival, statistical, scientific, or historical research purposes consistent with Applicable Law; - for the operational integrity of the Platform (including backup, audit, and dispute-resolution purposes); or - on any other ground permitted by the PDPL.
Where we cannot delete the Personal Data, we may Anonymise it instead. Once Anonymised, the data is no longer Personal Data and falls outside the scope of this right.
11.5 Right to Restriction of Processing (Art. 17)
You may request that we restrict processing of your Personal Data in the limited circumstances permitted by the PDPL (for example, while accuracy is verified or while an objection is being assessed).
11.6 Right to Data Portability (Art. 18)
You may request that we transmit Personal Data you provided to us, in respect of which the legal basis is consent or performance of a contract, in a structured, commonly used, machine-readable format, where technically feasible. This right does not extend to inferred or derived data, to data we have created from your activity, or to data covered by other lawful bases.
11.7 Right to Object (Art. 19)
You may object to processing of your Personal Data based on legitimate interests in the circumstances permitted by the PDPL. We will cease such processing unless we can demonstrate compelling legitimate grounds that override your interests, rights, and freedoms, or where the processing is necessary for the establishment, exercise, or defence of legal claims, or for any other ground permitted by the PDPL.
You may object to direct-marketing processing at any time without giving reasons.
11.8 Rights in Relation to Automated Decision-Making (Art. 20)
You have the right to object to decisions taken solely on the basis of automated processing (including profiling) that produce legal effects or similarly significantly affect you. We do not currently take any such decisions on a fully automated basis (see Section 16).
11.9 Right to Withdraw Consent
Where we rely on your consent, you may withdraw it at any time without affecting the lawfulness of processing carried out before withdrawal or processing carried out on another lawful basis.
11.10 Right to Lodge a Complaint
If you believe that our processing of your Personal Data infringes the PDPL, you have the right to lodge a complaint with the UAE Data Office. We would, however, appreciate the opportunity to address your concern first by contacting privacy@menahomes.com.
12. How to Exercise Your Rights
To exercise any of the rights in Section 11, please email privacy@menahomes.com with:
(a) the name on your account and any other details necessary to enable us to identify you;
(b) the right(s) you wish to exercise;
(c) the specific Personal Data or processing activity concerned (where relevant); and
(d) a copy of valid government-issued photographic identification (Emirates ID or passport) to enable us to verify your identity. We will not act on requests we cannot reliably tie to the data subject, and we may request additional information where necessary.
We will acknowledge your request and respond within the timeframes prescribed by the PDPL Executive Regulations. If your request is complex, broad, or you have made multiple requests, we may extend the response time and will inform you of the extension and the reason for it.
There is normally no charge for exercising your rights. If a request is manifestly unfounded, repetitive, or excessive, or requires significant effort to fulfil, we may charge a reasonable fee or refuse to act on the request, and we will explain our decision.
We may, in our sole discretion, choose to fulfil a request in part rather than in full where doing so is reasonable in the circumstances.
13. Security
We implement reasonable technical and organisational measures designed to protect Personal Data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure, or access, having regard to the state of the art, the cost of implementation, the nature of the data, and the risk profile. These measures may include (depending on the data and the risk):
- encryption of data in transit and at rest; - access controls, role-based permissions, and the principle of least privilege; - multi-factor authentication for administrative accounts; - secure software-development practices and periodic vulnerability testing; - network segregation, firewalls, and intrusion-detection systems; - logging, monitoring, and alerting; - staff training and confidentiality obligations; - vetting of service providers and PDPL-compliant contracts; - backup, disaster-recovery, and business-continuity processes; and - incident-response procedures.
No security control is perfect, and the security of any data transmitted over the internet cannot be guaranteed. We make no warranty or guarantee of absolute security and shall not be liable for any breach, attack, intrusion, or compromise that occurs despite our reasonable measures, or that arises from circumstances beyond our reasonable control (including but not limited to the acts of malicious third parties, the failure of third-party providers, or your own act or omission).
You play an important role in protecting your account by choosing a strong password, keeping your credentials confidential, enabling two-factor authentication where offered, keeping your devices and software up-to-date, and notifying us immediately at privacy@menahomes.com of any suspected unauthorised access. We are not liable for any loss arising from your failure to do so.
14. Personal Data Breaches
In the event of a Personal Data breach that we reasonably consider is likely to result in a high risk to the rights and freedoms of affected individuals, we will:
- notify the UAE Data Office to the extent and within the timeframes required by the PDPL and its Executive Regulations; and - notify affected data subjects to the extent and within the timeframes required by the PDPL and its Executive Regulations.
We are not obliged to notify any breach where, in our reasonable judgment, the criteria for notification under the PDPL are not met, or where notification is not required by Applicable Law.
15. Children's Privacy
The Platform is not directed to children. You must be at least eighteen (18) years of age and have full legal capacity to register an account or enter into transactions through the Platform.
We do not knowingly collect Personal Data from persons under thirteen (13). If you become aware that a child under thirteen has provided Personal Data to us, please contact privacy@menahomes.com so we can promptly delete it.
If you are between thirteen (13) and seventeen (17), you may browse public areas of the Platform only with the supervision and permission of a parent or legal guardian. A parent or guardian is solely responsible for any data submitted on a minor's behalf, and shall defend, indemnify, and hold the MENA Homes Group harmless from any claim arising from such submission.
16. Automated Decision-Making, Profiling, and Machine Learning
We use automated tools, statistical models, and machine-learning systems to support — but not replace — human decision-making and to operate, personalise, and improve the Platform. Examples include:
- search ranking, sorting, and filtering of Listings; - recommended Listings, Agents, and content based on your search history, preferences, and inferred interests; - behavioural segmentation and audience-modelling for personalisation and advertising; - fraud-detection signals and risk-scoring on accounts, Listings, and transactions; - matching enquiries to Agents and brokerages; - AML/CFT screening of payment transactions; - content moderation and detection of policy-violating Listings or messages; and - analytics and aggregated market-intelligence features.
We do not currently make decisions that produce legal effects or similarly significantly affect you on a solely automated basis within the meaning of Article 20 of the PDPL. Where an automated tool flags an account, transaction, Listing, or piece of Content for review, a member of our team makes the final decision.
We may use Personal Data, in conjunction with other data, to train, fine-tune, and evaluate machine-learning, artificial-intelligence, and statistical models (including models used by Agents, the MENA Homes Group, and our service providers to operate, secure, and improve services). Wherever practicable, we use Anonymised or de-identified data for these purposes. Where such processing involves Personal Data, our legal basis is legitimate interests or, where required, your consent.
If we introduce any solely automated decision-making that produces legal effects or similarly significantly affects you, we will update this Policy and comply with the requirements of Article 20 of the PDPL.
17. Links to and Integrations with Third-Party Services
The Platform may contain links to, or integrations with, third-party websites, applications, and services (including mortgage providers, mapping services, social media platforms, payment processors, listing-feed providers, advertising networks, and analytics providers). This Policy does not apply to those third-party services, which are governed by their own privacy policies. We encourage you to read them before sharing Personal Data with any third party. We are not responsible for the privacy practices of any third party.
18. Limitation of Liability and Time Limit on Claims
To the maximum extent permitted by Applicable Law, our liability in connection with this Policy and our processing of your Personal Data is subject to the exclusions, limitations, and liability cap set out in the Terms of Service, which are incorporated into this Policy by reference.
To the maximum extent permitted by Applicable Law, any claim or cause of action arising out of or related to this Policy or our processing of your Personal Data must be filed within one (1) year after the claim or cause of action arose, or be permanently barred, in addition to any shorter limitation period imposed by Applicable Law.
Nothing in this Section 18 limits or excludes any liability or right that cannot be limited or excluded under Applicable Law.
19. Changes to This Policy
We may update this Policy from time to time at our sole discretion to reflect changes in our processing activities, in Applicable Law, or in industry practice. The "Last Updated" date at the top shows when the Policy was last revised.
Where changes are material, we will use reasonable efforts to notify you in advance — for example, by email, by an in-app notice, or by a prominent notice on the Platform — and, where required by Applicable Law, obtain your fresh consent.
Your continued use of the Platform after the effective date of an updated Policy constitutes your acknowledgement of the updated Policy. If you do not agree with the updated Policy, you should stop using the Platform and may exercise your rights under Section 11.
